Q: I am a NRI since 1992. Am I eligible for income tax?
A: We assume your query is regarding tax liability in India. It will depend upon your residential status in the FY 2009-10 (as per Sec 6 of IT Act). Below are the 2 basic conditions for determining residential status of an individual assessee:
1) He is in India in the previous year (FY 2009-10) for a period of 182 days or more.
2) He is in India for a period of 60 days or more during the previous year and 365 days or more during 4 years immediately preceding the previous year. If neither of the above conditions are met by you, then you are an NRI in FY 2009-10. In such a case, you would be liable to tax on income received or accrued in India or deemed to accrue or arise in India. But your foreign income shall not be taxable.
